The points below constitute the legal terms and conditions for the use of the website of The Belgian Lighthouse and govern the legal relationship between on the one hand The Belgian Lighthouse and on the other hand any person making use of the website of The Belgian Lighthouse (hereafter referred to as ‘the user’).

By his visiting the website, the user confirms to have read and to accept the terms and conditions.

1. Identification

The Belgian Lighthouse, enterprise number BE 0729 909 657, located at Milseweg 9/0103, 3001 Heverlee, Belgium.

2. Deviations from these terms and conditions

In exceptional circumstances deviations from these terms and conditions are permitted, insofar these deviations are put in writing and have been agreed upon by all concerned parties. These deviations only serve as replacement or extension of the clauses they relate to and do not alter the applicability of any other stipulations in the terms and conditions.

3. Modification of these terms and conditions

The Belgian Lighthouse can modify these terms and conditions at all times. Ongoing sales agreements are always governed by the terms and conditions as they were stipulated at the moment the agreement was established. Every order placed after the modification implies the user accepts the new terms and conditions.

4. Offered goods

The product range of The Belgian Lighthouse consists of books, e-books (books in digital format) and photo calendars. Offered goods are valid while supplies last and can be changed at all times.

Key characteristics and additional detailed information about each product are clearly described on the website.

5. Prices and currency

All prices are displayed, and are payable, in Euros.

The product prices displayed on the website include all applicable taxes and do not include shipping costs.

The Belgian Lighthouse is a small enterprise in auxiliary profession operating under the statute “Special exemption regime small enterprises” (Bijzondere vrijstellingsregeling kleine ondernemingen). No VAT is charged.

6. Delivery and shipping costs

Delivery of non-digital goods carries shipping costs. These costs are calculated based on the weight of the goods and the delivery method chosen by the user.

The user may at all times estimate the total shipping costs for the items currently in his basket by supplying a provisional delivery location (city and country) on the website (page “Basket”).

The shipping costs due for the delivery destination and shipping method chosen by the user are clearly and explicitly marked in the order preview before the user actually places an order.

Delivery of ordered goods is carried out by postal services or international couriers. The Belgian Lighthouse cannot be held responsible for delivery delays caused by such postal services and couriers.

Deliveries in the United States (USA) and the United Kingdom (UK) may incur additional customs and/or import taxes. These taxes are expressly borne by the user.

For orders of digital products (e-books) no shipping costs are charged.

7. Modalities and accepted ways of payment

The Belgian Lighthouse partners with Stripe and PayPal for a safe and efficient processing of online payments.

The user is offered the following means to securily pay online on our website:

  • Bancontact (Only available for users on Belgian territory);
  • Credit Cards (Visa, MasterCard);
  • PayPal account.

In addition, the user may choose to pay his order “offline” through a regular bank transfer (wire transfer) into the following account at ING Bank:

Please note, orders payable by bank transfer are only processed and fulfilled after the total amount due has been received and cleared in our account.

8. Modalities for establishing an online sales agreement

Our website, and possibility to establish a sales agreement, is offered in three languages: English, Dutch and French.

By placing an online order the user accepts the terms and conditions applicable at that time.

The Belgian Lighthouse reserves the right to refuse a sales order. The mere expression of a user’s desire to acquire a product is therefore not sufficient for establishing an agreement.

9. Modalities for execution of a sales agreement

The Belgian Lighthouse strives to process and ship orders to the user within 14 days after receipt of payment.

If due to unforeseen circumstances The Belgian Lighthouse will be unable to deliver goods within the legally determined maximum term of 30 calendar days following the placement of the order, the user will be informed by email on the email address supplied by the user. The user may then choose to cancel his order, after which The Belgian Lighthouse will reimburse the amount the user had already paid for the goods. The sales agreement is thereby automatically dissolved as regards these goods.

The Belgian Lighthouse cannot be held responsible for damages incurred by a late or non delivery.

10. Right of withdrawal

The user has the right to cancel his purchase within 14 calendar days starting on the day of delivery, except for digital products (e-books).

For digital products (e-books) the right of withdrawal does not apply. By placing an order containing digital products, the user agrees to receive download links to these digital products immediately after the payment has been processed, and thereby explicitly renounces his right of withdrawal for these digital products.

The user can exercise his right of withdrawal by returning the goods, accompanied by the invoice and the filled out model form, to The Belgian Lighthouse, Milseweg 9/0103, 3001 Heverlee, Belgium.

Any shipping costs incurred for returning the goods are borne by the user.

Under the condition that the goods are still in mint condition, The Belgian Lighthouse will reimburse the returned goods within 30 calendar days following receipt of the goods.

The user is obliged to notify any problems relating to his order or delivery to The Belgian Lighthouse within 7 calendar days after such problems have occurred.

The liability of The Belgian Lighthouse for complaints about orders or deliveries shall always be limited to the value of the implicated goods.

11. Liability disclaimer

The Belgian Lighthouse makes efforts to make and keep the information provided by the website as accurate as possible. The Belgian Lighthouse can nevertheless not be held responsible for direct or indirect damages resulting from the use of information on this website. Product images and descriptions cannot be considered binding.

The contents of the website may at all times and without prior notification be modified or extended.

The Belgian Lighthouse offers no warranties for the correct functioning of the website and cannot be held liable in any way for poor functioning or temporary unavailability of the site or for any form of direct or indirect damages that may result from access to or use of the website.

Our website contains downloadable content. Any download from our website is carried out under the user’s own risk. Any damage arising from loss of data or damage to computer systems falls completely and exclusively under the responsability of the user.

12. Intellectual property rights

The content and layout of this website, including logos, photographs, en text, are protected by intellectual rights and belong to The Belgian Lighthouse or entitled third parties.

13. Applicable law and governing court

Alle disputes arising from the use of this website shall be governed under Belgian law by Courts presiding over the legal district of Leuven.

14. Consumer protection

The Belgian Lighthouse vouches that supplied products comply with the sales agreement, with the specifications listed on the offer, with the resonable requirements of reliability and/or usability, and with the legal provisions and/or government regulations applicable on the date of the establishment of the agreement.

Complaints about the execution of a sales agreement shall be submitted to The Belgian Lighthouse, within a reasonable time frame and with a clear and full description, once the consumer has noted the shortcomings.

Received complaints will be replied to within 14 days following the day of receipt. In case a complaint requires a longer processing time, the user will receive within 14 days a confirmation of receipt of the complaint, together with an indication of when the user can expect a more comprehensive response.
